1. Description of Promotion

Welcome to the Daily Bonus promotion (the “Promotion”), where, subject to these Terms and Conditions, eligible participants who satisfy the Promotion Requirements (as defined in Section 4 below) will receive a Mystery Bonus (as defined in Section 5 below) and, subject to the number of times the Promotion Requirements are satisfied during the Promotion Period, the Trick or Treat Bonus (as defined in Section 5 below).The Promotion is sponsored by TSG Interactive US Services Limited (“TSG” or “Sponsor”).  In these Terms and Conditions, a reference to  “you”,“your” or @participant(s) is a reference to persons wishing to participate in the Promotion. Participation in the Promotion  and redemption of the Mystery Bonus is expressly conditioned upon acceptance of and compliance with all of these Promotion “Terms and Conditions”.  You  may be required to sign paperwork issued by the Sponsor.

2. Promotion Period

The Promotion will begin at 8:00 AM ET on November 9, 2023 and end at 11:59 PM ET on November 8, 2024 (each a “Promotion Day” and collectively the “Promotion Period”).

3. Eligibility

To enter the Promotion, you must be at least 21 years of age, have a PokerStars Account (as defined in Section 6 below), be physically present in New Jersey or Pennsylvania when you participate in the Promotion (depending on whether you are playing on the www.pokerstarsnj.com, pokerstarsmtairycasino.com or www.pokerstarsmi.com website respectively), and have received the  Invitation (as defined in Section 4 below) from the Sponsor. The Invitation is non-transferable and if you are not directly invited by the Sponsor, you will not be eligible to participate in the Promotion. If your social security number is associated with more than one PokerStars Account, you may only earn one Mystery Bonus via one PokerStars Account under this Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Mystery Bonus. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, the Sponsor and/or one or more of its affiliates and/or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions in which the Sponsor and/or its affiliates and/or gaming license partners operate are not eligible to participate in the Promotion or receive a Mystery Bonus.

4. Action Requirements

To participate in the Promotion, on any Promotion Day of the Promotion Period you must opt-in to the Promotion via the invite displayed in the ‘Challenges’ section of your PokerStars Account and either:

Wager Method: Account holders must log in during the Promotion Period and opt in in the Challenges section of their TSG Account (as defined below) to participate in the Promotion. After opting-in, place one or more real money wagers totaling at least One Dollar ($1) on any of Sponsor’s Casino games” during the Promotion Period (“Wager Requirement”). You may place either one single wager or multiple wagers in order to meet the Wager Requirement. 

Alternate Method of Entry: Alternatively, participants may enter this Promotion by completing the form found at the link below, printing it and mailing it to PokerStars #1096 2230 Route 70 W STE 2 Cherry Hill, NJ 08002 along with a picture of your driver’s license or proof of age. All Entries submitted via the Alternate Method Entry must be submitted during the Promotion Period (i.e., one (1) Alternate Method of Entry submission per Promotion Day) to qualify as an eligible “Alternate Method of Entry”.  Individuals must have a TSG Account to submit an Alternate Method of Entry.  Alternate Method Entries form available here: https://bit.ly/3DfwEpU. (Collectively, the “Entry Requirements”). There is a limit of one (1) Entry per Promotion Day regardless of entry method.

5. Claiming Promotion Offer

Upon satisfying any of the Entry Requirements on a given Promotion Day, you will receive a Mystery Chest containing one (1) of the following bonuses or offers:

• Casino Instant Bonus: between $1 - $500
• Bonus Spins: between 2 – 5 (.20c per spin)
• Subsequent casino challenges:
  • Bet X, Get Y
  • Deposit X, Get Y
  • X% back up to $X
  • Bet insurance up to $5

Each Mystery Bonus must be utilized within twenty-four (24) hours of issuance at which the Mystery Bonus will automatically expire. 

In addition to the Promotion Bonus, any player who satisfies the Wager Requirement on Five (5) consecutive Promotion Days (the “Activity Requirement”) will receive a Spin & Go ticket equal to One Dollar ($1) (the “Spin & Go Bonus”). Players are eligible to receive a Spin & Go Bonus every time they satisfy the Wager Requirements on Five (5) consecutive days. There is a limit of Thirty-Six (36) Spin & Go Bonuses per person during the entirety of this Promotion Period.   

If applicable any Mystery Bonus/Spin & Go Bonus awarded in this Promotion will be credited to your TSG Account within seventy-two (72) hours of your satisfaction of the Entry/Activity Requirements. Promotion reward recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion reward received, regardless of whether the Promotion reward, in whole or in part, is used.  Prizes are non-transferable, with no equivalents or substitutions except at Sponsor’s sole and absolute discretion. All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide the winner with his or her prize(s), the Sponsor may elect to provide winners with the approximate value of such item in cash or award an alternate prize of comparable or greater value. All prizes are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether they, in whole or in part, are used. The approximate retail value (“ARV”) of the prizes is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winners may be required to provide Sponsor with a valid social security number before the prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winners, or if a minor in the jurisdiction in which s/he resides, in the name of his/her parent or legal guardian, for the actual value of the prize received. Unclaimed prize(s) will be forfeited. Prize(s), if legitimately claimed, will be awarded.  The Promotion Entities are not responsible for and will not replace any lost, mutilated or stolen prizes or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address. If a winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and the Promotion Entities will have no further obligation with respect to that prize or portion of the prize. The Promotion Entities are not responsible for and winner will not receive the difference, in any, between the actual value of the prize(s) at the time of award and the stated ARV in these Official Rules or in any Promotion-related correspondence or material. Limit of one (1) Mystery Bonus per Promotion Day in connection with this Promotion.

6. Registration Procedures

To qualify for the Promotion, you must have an active account on pokerstarsnj.com, pokerstarsmi.com, or pokerstarsmtairycasino.com (“PokerStars Account”). Creating a PokerStars Account is free, however you will be required to verify your identity and agree to the Sponsor’s Terms of Service and Privacy Policy for the relevant website. If you do not agree to the relevant website’s Terms of Service and Privacy Policy, you cannot create a PokerStars Account or participate in the Promotion.

7. Limitations on Participation

In addition to the eligibility requirements in Section 3, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any Promotion for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. This Promotion is void where prohibited by law. 

8. Wagering Requirements

See Section 4 for the wagering requirements for Mystery Bonuses (in addition to details of the Alternate Entry Method for wager-free participation in the Promotion). Mystery Bonuses and the Trick or Treat Bonus are not transferable and cannot be substituted except in the Sponsor’s sole discretion. With the exception of cash prizes, Mystery Bonuses and the Trick or Treat Bonus may only be used for wagering on your PokerStars Account. Notwithstanding the foregoing, the Casino Site Credit may be converted to cash by earning 2 redemption points for every $1 in Casino Site Credit awarded on any of Sponsor’s table and slot casino games, excluding live dealer table games. Redemption points are earned based on the game type and amount wagered. Redemption points are not transferable and cannot be substituted except in the Sponsor’s sole discretion.

9. Order of Funds Used for Wagering

Casino Site Credit is used before deposited funds when wagering.

10. Eligible Games

All casino games offered during the Promotion Period are eligible to earn a Mystery Bonus/Spin & Go Bonus.

Casino Site Credit can be used on all games, except the following:

- Craps in all States

- Live Dealer in PA

- Video Poker in NJ

11. Restrictions on Withdrawal

The Mystery Bonus and/or Spin & Go Bonus are non-withdrawable. See Section 8 for instructions on how to withdraw winnings from wagers placed using the Mystery Bonus. Any unused portion of the Mystery Bonus expires Twenty-Four (24) Hours after being credited to your TSG Account. Any unused Spin & Go Bonus will be automatically withdrawn from your TSG Account seven (7) days after being credited to your TSG Account. You may withdraw your deposited funds at any time.

12. Cancellation

Should you wish to cancel your participation in the Promotion at any time, please contact customer support at support@starssupportnj.com (for New Jersey participants), support@starssupportpa.com (for Pennsylvania participants) or support@starssupportmi.com (for Michigan participants). Upon cancellation, you may withdraw any funds you have deposited into your PokerStars Account without restriction. However, expect for cash prizes, any Mystery Bonus or Trick or Treat Bonus in your PokerStars Account may not be withdrawn.

14. Additional Terms

Administration:  The Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent.  Administration of this Promotion is at the sole discretion of the Sponsor.  Sponsor reserves the right to restrict at any time any TSG Account holder from participating in this Promotion for any reason.  Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability:  By redeeming this Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Mystery Bonus/Spin & Go Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence.  The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Mystery Bonus.  In consideration of the Mystery Bonus/Spin & Go Bonus, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution:  The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.  The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in New York, New York.  The federal or state law that applies to these Terms and Conditions will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York.  The Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing).  Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Miscellaneous:  No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
